1. Introduction

These terms and conditions (the “Terms”) govern your access to and use of the website, its related pages, services, subdomains, applications, and tools (collectively, the “Website”). Hamel Al Mesk Shop (referred to as “we,” “us,” or “our”) owns and operates the Website.

We provide the Website as a service that allows users to browse and order products and other goods or services (“Products”). By using the Website, you acknowledge that your use is subject to these Terms, including any linked policies such as our Privacy Policy. If you do not agree to these Terms, you must not use the Website.

We reserve the right to change these Terms at any time. Changes will be posted on the Website with their effective date. You are responsible for reviewing the Terms each time you use the Website. Continued access or use after a change constitutes acceptance of the revised Terms.

2. User Account and Registration

To access certain features, including online store credit or eGift Card redemption where available, you may need to create a password-protected account (“Account”). Your Account is personal and non-transferable.

You must be of the legal age required to purchase Products in Kuwait and must provide accurate and complete registration information. A parent or guardian may permit a minor to use an Account but remains responsible for all activity carried out through that Account.

You are responsible for maintaining the confidentiality of your Account and password and for all activities that occur under your Account. Please contact us immediately if you suspect unauthorized access, misuse, or any other security concern.

3. Orders and Delivery

Placing an Order

Registered and guest users may order and purchase Products. You agree to pay the full amount shown during checkout, including applicable delivery and installation charges.

Order Acknowledgement and Confirmation

After you place an order, we may send an acknowledgement showing the order details.

Pricing, Availability, and Errors

Pricing, product, or transmission errors may occasionally occur. We will act in good faith to resolve such errors and may ask you to reconfirm the order at the correct price or cancel it. Products are supplied subject to availability.

A minimum order value may apply and may change from time to time. Delivery charges are shown during checkout. Where a Product is sold by weight or volume, you will be charged for the actual quantity delivered.

Order Changes and Cancellations

To change or cancel an order, contact Hamel Al Mesk Customer Service before dispatch. Because preparation and delivery may begin quickly, changes cannot be guaranteed. We reserve the right to charge reasonable additional costs resulting from a requested amendment or cancellation.

Delivery

• Products are delivered only within Kuwait.
• We aim to deliver within the selected or communicated delivery window, but delivery on a particular date or at a specific time is not guaranteed.
• Delivery will be made to the confirmed delivery address supplied with the order or stored in your Account.
• If the address is incorrect or no one is available to receive the order, you may be responsible for reasonable redelivery charges.
• An order is considered delivered when received by you or another person at the designated address, or when placed in an agreed delivery location.

If you are not satisfied with an order, please contact Customer Service. Any refund remains subject to these Terms and our applicable return policy.

4. Payments

Payment is collected from your credit card, debit card, KNET account, or another supported payment method after the payment details are checked. If we cannot supply a Product, we will notify you and arrange a refund where payment has already been collected.

We may direct you to secure payment gateways such as KNET, Mastercard payment services, or TAP Payments. Payment details are encrypted and processed through the applicable gateway. We may also validate supplied information against third-party databases for accuracy and fraud prevention. These checks do not affect your credit rating and are handled in accordance with applicable data protection laws.

The relevant payment gateway and card-issuing bank are responsible for verifying the customer and payment information and authorizing the transaction. Hamel Al Mesk is not responsible for losses caused by fraudulent transactions unless liability cannot be excluded under applicable law.

All prices are displayed in Kuwaiti Dinar (KWD), include applicable taxes, and exclude delivery charges unless stated otherwise. The price charged is the price displayed when we receive the order, except where a clear error has occurred.

Risk of loss or damage and title to Products pass to you upon delivery to the confirmed address, or on the date of the first attempted delivery where you fail to receive the order, subject to our receipt of full payment.

5. Online Promotions

Online discounts and promotional sales apply only to Products identified as part of the promotion. Promotions are subject to any specific conditions shown on the product page, promotion page, or during checkout.

Promotions may include:

• Percentage or fixed-value discount codes.
• Limited-time offers, flash sales, or weekend promotions.
• Clearance pricing on selected Products.
• Free-delivery promotions that require a minimum spend.
• Bundle offers for purchasing selected Products together.

Hamel Al Mesk may amend, suspend, or cancel a promotion without prior notice. Restrictions may include a minimum order value, excluded Products, limited quantities, one use per customer, or a specific redemption deadline. By using a promotion, you agree to its specific conditions.

6. eGift Cards

• eGift Cards (“Gift Cards”) may be used only on the Website.
• Gift Cards are delivered to the email address entered during checkout.
• Gift Cards are valid for one year from the purchase date.
• An Account may be required to redeem a Gift Card.
• Gift Cards cannot be used to purchase additional Gift Cards.
• Gift Cards cannot be returned, exchanged, or refunded.
• Any balance remaining after expiry will not be refunded. The holder is responsible for redeeming the balance before the expiry date.

7. Returns and Exchanges

We aim to comply with applicable Kuwait consumer-protection laws and provide a fair and transparent return and exchange process.

• A full refund may be requested within 14 days of the purchase date. shipping fees are non-refundable and will be deducted from the refund amount.
• An exchange may be requested within 14 days of the purchase date. this applies to nursery clothing only, toys are not eligible for exchange.
• Returned items must be unused, unworn, unwashed, undamaged, and in their original packaging.
• A valid receipt or other accepted proof of purchase is required.
• Products are refunded or exchanged only for the amount originally paid.

Exceptions

• Sports equipment, swimming pools, and Products installed by our delivery team cannot be returned or exchanged unless they have a manufacturing defect.
• Sale items are not eligible for refunds except where required by law.

Refunds

Hamel Al Mesk Shop reserves the right to determine whether a refund or exchange is available, subject to applicable law. Refunds are issued for the original purchase price, unless discounts, promotions, and applicable shipping costs.

For partial returns, the original discount or promotion may be recalculated against the Products retained. Replacement Products are not automatically eligible for the original promotional code; you may place a new qualifying order or pay any applicable price difference.

Return Procedure

To request a return, contact Hamel Al Mesk Customer Service. Eligible Products may be returned using the approved online return process, which may carry a collection fee, or at an eligible Hamel Al Mesk location where accepted.

Refund Methods and Timing

• KNET and credit/debit-card refunds are generally processed within seven business days after the returned Product is received and approved.
• Online store credit, where selected and available, may be issued after the returned Product is received and approved.
• Cancellation refunds will use the selected and available refund method and remain subject to the conditions above.

If a refund has not appeared after the stated processing period, please contact Hamel Al Mesk Customer Service first so we can check its status. If needed, we may then ask you to follow up with your bank or card issuer.

8. Intellectual Property

All copyrights, trademarks, and other intellectual-property rights in the Website and its materials belong to Hamel Al Mesk or its licensors. You may use Website content only as expressly permitted by us or the relevant licensor.

Product names, trade names, service names, taglines, and logos (“Marks”) are owned by or licensed to Hamel Al Mesk. You may not use any Mark without prior written consent, except to identify Products or Services originating from us.

Website content is provided for personal, non-commercial use. You must not copy, reproduce, transmit, publish, display, distribute, commercially exploit, or create derivative works from it except as permitted by law or with prior written authorization.

Where the Website allows reviews, comments, questions, suggestions, or other submissions (“User Content”), you confirm that your submission is original and does not infringe third-party rights. You grant Hamel Al Mesk a perpetual, irrevocable, non-exclusive, royalty-free license to use that User Content.

You must not submit unlawful, defamatory, inflammatory, offensive, or infringing content. We may monitor, edit, or remove User Content but are not responsible for User Content submitted by customers or other third parties.

9. Liability and Indemnity

We do not guarantee that the Website or Services will always be uninterrupted, secure, or error-free. Delays, omissions, interruptions, or inaccuracies may occur. The Website, its content, information, and links are provided on an “as-is” and “as-available” basis to the fullest extent permitted by law.

To the fullest extent permitted by law, Hamel Al Mesk disclaims express, implied, and statutory warranties relating to the Website, Services, or the accuracy, currency, and completeness of information, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Where liability cannot be excluded, Hamel Al Mesk’s aggregate liability in contract, tort, or otherwise for loss or damage arising from one incident or a series of related incidents is limited to the amount paid or payable for the relevant Products, subject to applicable law.

We take reasonable precautions to protect order and payment information. Unless we have been negligent or applicable law provides otherwise, we are not responsible for loss caused by unauthorized access to information you provide.

We may refuse service, suspend or terminate Accounts, remove or edit content, or cancel orders at our discretion, subject to applicable law.

To the fullest extent permitted by law, you agree to indemnify and hold harmless Hamel Al Mesk, its directors, officers, employees, affiliates, agents, contractors, and licensors against claims arising from your breach of these Terms, misuse of the Website or Services, violation of applicable law, or infringement of third-party rights.

10. Warranty Terms

Certain Products may include a warranty against defects after purchase, as stated in the applicable product description. Warranty coverage applies only to defects in material, design, or workmanship unless stated otherwise.

Warranty remedies may be limited to repair, replacement of the defective part, replacement of the Product, or a refund based on the Product’s applicable value, at Hamel Al Mesk’s discretion and subject to applicable law.

Not every Product includes a warranty. Please check the product page before purchase to confirm whether warranty coverage applies.

11. Dispute Resolution

These Terms and any dispute arising from or related to your use of the Website or Services are governed by and interpreted in accordance with the laws of the State of Kuwait.

Any dispute arising from these Terms or your use of the Website or Services is subject to the exclusive jurisdiction of the courts of the State of Kuwait.
